I live next door to a vacant house. The original owners passed away, and their children now share ownership, but none of them live there.
  • Recently, I decided to plant a few bushes along the property line to increase privacy. A few days later, while visiting the house, the son saw the bushes and absolutely freaked out.
  • He was screaming and saying he was going to rip them up, etc. I calmly agreed to remove them to prevent further conflict (the son has a violent criminal history), as they were probably right on the border of the property line.

  • After I removed them, he started claiming that other plants and trees I had planted were on his property.
  • He kept threatening that if I didn't remove them all by the next day, he would rip them out himself.

  • I dug up the documentation I received when I bought the house to show him that the plants and trees were, in fact, on my property.
  • He disagreed. I threatened to call the police and contacted a lawyer, which caused him to back down.

  • My neighbor then proceeded to litter his front and side yards with pink plastic flamingos, six security cameras, and multiple "Private Property" signs.
  • It looks terrible in our quiet suburban neighborhood. A few days later, he said he wanted to get a survey done and that we needed to split the $2,000 cost.
  • I basically told him no and stopped responding. He went ahead and purchased a new survey anyway, and the next day, a surveyor was on our property assessing the boundary line.

  • According to the surveyor, my property is larger than I originally thought. Not only were all of my plants and trees well within my property line, but my neighbor's backyard fence is a full 1.5 feet onto my property.
  • Now the neighbor has been completely silent. I spoke with the survey company he hired, and they said he told them not to submit the new survey to the county.
  • How should I proceed? I want my neighbor to take down all the eyesores he put up, but not sure how to go about it.

  • I'm nervous if I extend my fence (which I can do now, according to the surveyor) that my neighbor will shoot me Imao

  • Flimsy-Fortune-6437 Put your trees back in to start with

  • OP tangled Dream If the trees grow over the line, I think that would cause issues. Trying to find the safest route to block view of his new "decorations" and cameras
  • GrlInt3r46 Replant your bushes. On the proper line. Absolutely have the survey recorded and start an action to remove the fence. They started this. Finish it. Sweep the leg.
  • OP tangledDream According to the survey company, they can't record it if the purchaser tells them not to. I actually talked to the survey guy and he was super nice and on our side, but said their hands are tied. edit: thanks for the replies, but spending $2k to solve a problem started by my neighbor isn't my ideal outcome, but if that's what I have to do, I will

  • Wolverine-7509 Ask the surveyor for a copy of that document, whatever it costs. "What is your cost to "re-do" this survey for me, so I can submit it?" Then take that copy to the town or county and ask what should be done to rectify the legal records. Dont do anything egregious, just make sure you quietly set the record straight in all appropriate channels. Edit: And just replant your stuff, unless you NEED the space. This is going to be settled with a future owner or you will end up with retalia
  • Mr_Torque You could tear down your fence and move it a foot or over.
  • ShowMe The Trees Go ahead and hire that lawyer. His fence is on your property. You need to take the steps to reclaim your land. Install cameras.

  • Interesting_Wing_461 I agree, they started it, finish the game.
  • Leviosapatronis I assume you contacted the company and got a copy of the survey? If so, go over and kindly ask the neighbor to take down the eyesore, in turn, you will not go to the county with the info you have. If he refuses, take it to the county.
  • Ok_Bid_3899 Get a copy of that or another paid for survey By you and have recorded officially at your county recorder of deeds or this could start all over again at a later date. Recording it make it official

  • Neat-Ad8056 Put your trees back and just be done with it tbh You could also consider threatening the fence removal in exchange for him removing the flamingos
  • Historical_Agent9426 Submit the survey to the county Tell your neighbor you plan to remove the fence he installed on your property. If he gives you any guff, tell him you will bill him for the removal cost as he never received permission from you to put a fence on your property, nor does he have an agreement to rent the land he has been encroaching on.
